How to Get a Succession Certificate 

A district court with the required jurisdiction can issue a succession certificate. For instance, the succession certificate will be obtained from Punjab if the jurisdiction is Punjab. In accordance with the specified jurisdiction, it is issued by the district judge. A petition must be prepared and submitted to the designated district court in that jurisdiction in order to obtain a succession certificate.

It should be noted that the district court where the petition to obtain the succession certificate is being filed must have jurisdiction over the location where the deceased person resided at the time of their death. In the event that no such location is available, the region to which any deceased person’s property belongs will serve as the relevant jurisdiction.

Procedure for Obtaining a Succession Certificate 

The following describes the legal procedure for obtaining a succession certificate:

 Step 1: Preparation of the Petition In order to obtain a Succession Certificate, the applicant must prepare a petition and submit it to the relevant district judge along with payment of the required fees.

Step 2: After the petition is submitted to the court, the district judge will give the petitioner a chance to be heard at the preliminary hearing. If the petition is accepted, the district judge will then set a date for the final hearing, and notices will be sent to the parties involved.

Step 3: Grant of Certificate On the date of the hearing, the district judge will decide if the applicant has the right to apply for a succession certificate after hearing all relevant parties. If he is satisfied, he will then issue the certificate.

Step 4: In addition to the required information in the petition, the district judge may request a bond with surety or other security to guarantee that the succession certificate will not be misused in any way. It should also be noted that the district judge may, if necessary, grant a security extension.

Effects of the Succession Certificate 

One of the objectives of the succession certificate is to safeguard the parties responsible for paying the debts in the event that the payments are being made honestly. According to the succession certificate, the holder has the authority to receive dividends or interest on securities and can negotiate or transfer securities in accordance with his wishes. As a result, the succession certificate holder’s payments for the deceased will be legally enforceable. However, it should be noted that the holder of the succession certificate is the legal heir or owner of these securities.
