Trademark

Trademarks and service marks are used to distinguish the products and services of a manufacturer or seller from other products in the market. A trademark or service mark prevents you from providing another person with a confusing similar product or service like yours. If you do not register your trademark, the registrant may be barred from using it. So it is essential that you get trademarks to show the uniqueness of your company. Trademark Registration Process:

You invest your time and money to build a particular brand. Seeing someone else use the same brand name and rob you of your hard-earned brand reputation is not acceptable. Many times, trademark owners end up in protracted cases because when the time was right they did not register the trademark in India under their brand name. The trademark registration process for a brand name is not a difficult task. Some simple steps, as explained below, will give you the much needed legal protection of your brand name registration in India.

Here you will find step by step information about trademark registration methods.

Step 1: Trademark Search:

Many entrepreneurs do not understand the importance of a DM search. Having a unique brand name in mind is not a sufficient reason to avoid DM search. DMDial helps to determine if there are similar trademarks, and it gives you a fair picture of where your trademark stands, and in some cases, a forecast of the possibility of a trademark case.

Step 2: Filing a trademark application:

Once you are sure that the brand name or logo of your choice is not listed in India in the trademark registry, you can choose to register it. The first step is to file the trademark application in the trademark register in India. Nowadays, filing is mostly done online. Once the application is filed, an official receipt is issued immediately for future reference.

Step 3: Choose:

After the trademark application is filed, the examiner will examine it for any discrepancies. The exam may take about 12-18 months. The examiner may accept the trademark in whole, on condition or subject.

If accepted unconditionally, the trademark will be published in the trademark magazine. If not accepted unconditionally, the conditions or objections to be met will be stated in the examination statement and a one-month period to fulfill the conditions or respond to the objections.

Once such a response is accepted, the trademark is published in the trademark magazine. If the answer is not accepted, one can request an inquiry. At trial, if the examiner feels that the trademark should be allowed to be registered, it is published in the trademark journal.

Step 4: Release:

The trademark registration process is linked to the release step, so anyone who opposes trademark registration has the opportunity to oppose it. If there is no resistance after 3-4 months from the release, the trademark continues to register. If there is opposition; There is a fair hearing and the results are provided by the registrar.

Step 5: Certificate of Registration:

Upon completion of the application for trademark registration, the certificate of registration is issued under the trademark of the trademark office following its publication in the trademark magazine.

Step 6: Update:

The trademark can be renewed permanently after every 10 years. Therefore, your logo or brand name registration may always be protected.

It does not take much effort to register a trademark in the India process. It’s a simple process. So it is imperative to register your trademark.
